These Terms of Service ("Terms") govern your access to and use of the websites, mobile applications, and online services (collectively, the "Services") provided by KOSUI FZC (UAE) and KOSUI PERFUME Pte Ltd (Singapore), hereinafter referred to as "KŌSUI," "we," "us," or "our."
By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our Services.
2. ELIGIBILITY
You must be at least 18 years old to use our Services. By using our Services, you represent and warrant that you meet this requirement and that you have the right, authority, and capacity to enter into these Terms.

4.1 Product Information
We strive to provide accurate descriptions of our products, including their composition, fragrance notes, and images. However, we do not guarantee that product descriptions, images, or other content on our Services are accurate, complete, reliable, current, or error-free.
4.2 Pricing and Availability
All prices are displayed in the selected currency and are exclusive of taxes unless otherwise stated. Prices are subject to change without notice. We reserve the right to limit the quantities of any products or services that we offer.
4.3 Allergies and Sensitivities
Our perfumes contain various ingredients, including natural extracts and aromatic compounds. If you have known allergies or sensitivities, please review product ingredients carefully before purchase. We are not liable for allergic reactions or sensitivities to our products.
5. ORDERS AND PAYMENTS
5.1 Order Acceptance
Your receipt of an order confirmation does not constitute our acceptance of your order. We reserve the right to accept or decline your order for any reason.
5.2 Payment Methods
We accept various payment methods as indicated on our checkout page. By providing payment information, you represent and warrant that you have the legal right to use the payment method and that the information you provide is accurate.
5.3 Taxes and Duties
You are responsible for any taxes, customs duties, or other governmental charges that may be imposed on your order. For international shipments, these fees may be collected at the time of delivery.
6. SHIPPING AND DELIVERY
6.1 Shipping Methods
We offer various shipping methods with different delivery timeframes and costs. Shipping options are presented during checkout.
6.2 Delivery Timeframes
Delivery timeframes are estimates only and are not guaranteed. We are not responsible for delays caused by customs clearance, weather conditions, or other factors beyond our control.
6.3 Risk of Loss
Risk of loss and title for items purchased pass to you upon delivery of the items to the carrier.
7. RETURNS AND REFUNDS
7.1 Return Policy
Products may be returned within 14 days of receipt if they are unopened and in their original packaging. Opened or used products cannot be returned due to the nature of perfume products, except in cases of manufacturing defects.
7.2 Refund Process
Refunds will be issued to the original payment method within 15 business days after we receive and inspect the returned product. Shipping charges are non-refundable unless the return is due to our error.
7.3 Damaged or Defective Products
If you receive a damaged or defective product, please contact our customer service within 7 days of receipt with photos of the damage or defect.
8. INTELLECTUAL PROPERTY
8.1 Ownership
The Services, including all content, features, and functionality, are owned by KŌSUI and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
8.2 Limited License
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use our Services for personal, non-commercial purposes.
8.3 Restrictions

If you submit product reviews, comments, or other content to our Services, you grant us a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media.

11.2 Product Disclaimer
While we make efforts to accurately describe our products, we do not warrant that product descriptions, color accuracy, or other content on our Services are accurate, complete, reliable, current, or free from errors.
12. LIMITATION OF LIABILITY
IN NO EVENT SHALL KŌSUI, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES OR PRODUCTS.
13. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless KŌSUI, its officers, directors, employees, agents, licensors, and suppliers from and against all losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from any violation of these Terms or any activity related to your account.
14. TERMINATION
We reserve the right to terminate or suspend your account and access to our Services at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users of our Services, us, or third parties, or for any other reason.
15. GOVERNING LAW
15.1 For KOSUI FZC (UAE)
These Terms and your use of the Services as they relate to KOSUI FZC shall be governed by and construed in accordance with the laws of the United Arab Emirates, specifically the Sharjah Research Technology and Innovation Park (SRTIP) laws, without regard to its conflict of law provisions.
15.2 For KOSUI PERFUME Pte Ltd (Singapore)
These Terms and your use of the Services as they relate to KOSUI PERFUME Pte Ltd shall be governed by and construed in accordance with the laws of Singapore, without regard to its conflict of law provisions.
16. DISPUTE RESOLUTION
16.1 For Disputes with KOSUI FZC (UAE)
Any dispute arising out of or in connection with these Terms or your use of our Services in relation to KOSUI FZC shall be referred to and finally resolved by arbitration under the STRIP Arbitration Rules, which Rules are deemed to be incorporated by reference into this clause. The seat of arbitration shall be Sharjah, UAE. The number of arbitrators shall be one. The language of the arbitration shall be English.
16.2 For Disputes with KOSUI PERFUME Pte Ltd (Singapore)
Any dispute arising out of or in connection with these Terms or your use of our Services in relation to KOSUI PERFUME Pte Ltd shall be referred to and finally resolved by arbitration administered by the Singapore International Arbitration Centre (SIAC) in accordance with the Arbitration Rules of the SIAC for the time being in force, which rules are deemed to be incorporated by reference in this clause. The seat of arbitration shall be Singapore. The number of arbitrators shall be one. The language of the arbitration shall be English.
17. MODIFICATIONS TO TERMS
We reserve the right to modify these Terms at any time. If we make changes to these Terms, we will post the revised Terms on our Services with an updated "Last Updated" date. Your continued use of our Services following the posting of revised Terms means that you accept and agree to the changes.
18. SEVERABILITY
If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent under law.
19. ENTIRE AGREEMENT
These Terms, including our Privacy Policy and any other policies or agreements referenced herein, constitute the entire agreement between you and KŌSUI regarding the Services and supersede all prior agreements and understandings.
